All items are to be picked up on the scheduled appointment pick-up time frame listed for each auction. Any remaining items will either be disposed of or listed on a future auction to be resold (no refunds given for products that are not picked up). If you cannot make the scheduled pick-up time please contact prior to bidding to make arrangements. We know emergencies can happen, if you are unable to pick-up during the scheduled days, we will hold items up to5 daysafter the pick-up period ends,ONLY if you contact us prior to the end of the pick-up period. For this auction a $10 PER DAY STORAGE FEE WILL BE CHARGED for furniture items not picked up on time. We need our storage space! $5 PER DAY STORAGE FEES APPLY to smaller items requested to be held past the 5 day holding period. We are not always at our warehouse or available when you want to do a late pick up, as we may be at customer sites. You will have to pick up at a time we are available, we cannot always bend our schedule to accomodate late pick ups at your preferred times.
This is an online-only auction bound by all legal rights and remedies in the state in which the auction occurs. Do not bid if you cannot agree to the terms of this contract or are not able to pay and pick up your items within the specified terms of each auction. Inspection:This auctionoffers an inspection period
Payment:The default credit card on file with your account will be charged no later than 8:00am the day after the close of the auction. This allows the buyer time after the auction to select a different card on file from your default card to use for payment. All invoices not paid by 8:00 am the day after the auction closed WILL be charged against the default card on file, unless you indicate on your manage invoices page that you wish to pay onsite. If your payment is declined for any reason, you will not be able to pick up your items without paying. Payment onsiteisaccepted at this locationin the form of cash (exact change only, we will not always have change on hand), or debit/credit card via square processing.Invoices over $2,000 are not able to be paid by the credit card you have on file or via credit card processing on-site. You will need to pay with exact cash, wire transfer, or a cashier’s check. Exact change is required on all cash payments.
If you, as the winning bidder (Buyer), do not provide sufficient funds or fail to retrieve your item(s) within the scheduled pick-up times, you may incur fees from Equip-Bid. Not paying for your winning bids will result in an account ban on Equip-bid, and you may incur additional fees to re-instate your account. Multiple instances of not retrieving your items mayresult in a permanent block from the Equip-Bid site, causing additional fees to incur for reinstatement. Any bidder caught opening a new account will be charged an additional $50 with the above warnings. This is considered fraudulent bidding and is not tolerated.
Pick-Up:If you are unable to pick up your items during the scheduled pick-up times,please do not bid. By bidding in an Equip-Bid auction, you are legally bound to be charged for all won items and are agreeing to remove them from the auction location during the scheduled pick up times. In order to pick up your won items, you will need to reserve an appointment timeslot on your invoice page.
If you fail to pick up your won items within the scheduled timeframe,items will either be donated, resold at a future auction, or held for up to 5 days upon request from the bidder prior to the end of the available pick-up days, and additional $10 Per Day holding fee may apply to furniture items. The bidder must contact the auction manager listed on the details tab after the close of the auction and before the end of the scheduled removal time to make these hold arrangements. Any furniture or large/heavy items that must be moved will incur an additional moving fee or removal fee based on the items abandoned and any and all actual costs to move them to our warehouse, including U-Haul rentals. $5 Per Day Holding fees apply to small items being requested to be held past the 5 day period.
Regardless of any agreed upon storage of your items, all invoices must be paid by the end of the regular scheduled removal time period. You are still liable for paying for your item(s) and will be charged at the default credit card on file, regardless of whether or not you have picked up your items, or make extended pick-up arrangements.
Removal: Once a bidder has paid for and picked up their items, the items become the property of the winning bidder (buyer). The buyer assumes all risk of loss and damage to property from that point forward, including at the premises of the sale.
Refunds: If you receive an item that is damaged, does not work/function, or is missing pieces and it was not listed as such in the description, you are eligible to apply for a refund.Otherwise, no refunds will be given as there is no written or implied warranty on items.Please bid responsibly on untested items as they are sold as-is / where-is and pay attention to descriptions for additional information concerning item condition or function information. All refund requests must be submitted within 7 calendar days following the last scheduled pick-up day of the auction. No refund requests will be honored after this 7-day period. Please note that refunds are processed as soon as the returned items are received but can take 4 to 12 business days to process and return the money to your account.
Tax-Exempt Purchases: Tax exempt forms must be provided to each independent affiliate. Tax exempt statuses are not stored with your Equip-Bid account. If this is your first tax-exempt purchase withGolden Plains Estate Sales and Auctions LLC, contactPam on 316-833-1013by calling or texting for instructions to submit your tax-exempt form to us.We must receive your tax exempt certificate by 7:30 am the day following the auction close so that we can adjust your invoice before your default card is processed. No invoice adjustments will be made retroactively.
Liability:Golden Plains Estate Sales and Auctions LLC’sliability shall be limited to the refund of the bidder’s purchase price.
Limitations:The above-stated Terms cannot be altered except in writing by Equip-Bid.

CAUTION TO THE BIDDER:
For demonstration purposes, various pieces of equipment may be joined together. Do not assume a lot consists of more than one item simply because they are connected in a photo. You are bidding on the item as it is described and not the item in the photo.Golden Plains Estate Sales and Auctions LLCmakes an honest effort to ensure that the descriptions are accurate and the photos match to the best of our ability. However, an error can occur in the listing and in that case, it will be the description and not the photo that will be the item won. WARRANTY & CONDITIONS OF ITEMS SOLD:
All items are sold AS IS, WHERE IS, with NO WARRANTY expressed or implied by the lot number affixed to the item. This sale is for the business community as equipment and inventory without any implied or expressed warranty. Descriptions are believed to be accurate but not guaranteed. When not certain of the condition or use of an item, please bid accordingly and utilize inspection times.
CHOOSE WISELY, AND BID RESPONSIBLY:
We strive to provide excellent customer service and want everyone to get a good deal, and most will. However, when you bid on the wrong item or decide an item is not suited for your intended use, our clients are not willing to assume the cost of your mistake. Once bidding ends, the item is contractually sold to the highest bidder, and that item is the buyer’s property once picked up. When in doubt about the condition, completeness, or suitability for intended use, please bid accordingly. Golden Plains Estate Sales and Auctions LLC reserves the right to add or remove items from an auction, split or combine lots, add minimum bids or reserve prices, cancel, suspend, extend or reschedule an item and/or auction event, and make changes to the auction closing, inspection, removal times. Any controversy or claim arising out of or relating to this contract and/or agreement, or breech thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
